AUTM’s Comments on the USPTO’s Inventorship Guidance for AI-Assisted Inventions

The USPTO is requesting comments on the topic of “Inventorship Guidance for AI-Assisted Inventions”. AUTM continues to urge the USPTO to implement the Guidance and monitor its application to support patentability of inventions created with the assistance of AI to promote the progress of science and the useful arts. AUTM also suggests ways to make the Guidance more clear and helpful, as well as provides thoughts on additional steps the USPTO could take to incentivize innovation in the AI space.
 
The public comment period is now open. Public comments can be submitted at https://www.federalregister.gov/documents/2024/02/13/2024-02623/inventorship-guidance-for-ai-assisted-inventions. 
 
AUTM has submitted comments as approved by the Board of Directors and provided an editable version for Members to use as guidance as they form their own statements. Comments are due by May 13, 2024.
