Primer on Design Patents for TTOs In View of Recent Case Development

Design patents cover new and nonobvious ornamental designs and can be relatively quick and easy to obtain. It is a tool available to TTOs that is often overlooked or underutilized. In this webinar, we will review the basics of what is a design patent, what types of items it can protect, how to prepare a design patent, how design patents are found to be infringed under the traditional Gorham v White test and the new tests on validity in view of LKQ v. GM. We will also discuss open questions on how AI may change the game.

Presenters: Presenter Bios:
Charles Macedo advises and litigates in all areas of intellectual property law, including patent, trademark and copyright law, with a special emphasis in complex litigation. Charles develops patent strategies intended to prevent infringement challenges from arising in the future. He also has extensive experience with computer implemented innovations including machine learning, blockchain and metaverse.

David P. Goldberg focuses on domestic and international trademark law. He helps clients protect their brands domestically by researching trademark availability, filing applications for trademark registration and maintaining those registrations. He also works in close collaboration with a network of experienced counsel who provide the same services in other countries around the globe. David helps clients police and enforce their trademarks. For example, he has opposed before the U.S. Trademark Trial and Appeals Board the registration of trademarks that are confusingly like those of ARE Law's clients, including a major Japanese automobile maker and a premier U.S. department store.

Thomas Hart is an associate who started working at Amster, Rothstein & Ebenstein as a law clerk in May 2019. Thomas practices in all areas of intellectual property law, including patents, trademarks and copyrights. He assists in representing clients from global leaders in retail to university researchers on the cutting edge of science. Thomas’ experience touches all forms of IP. He has prepared and drafted patent applications, drafted inter partes review petitions and has performed prior art analyses for a variety of clients. In trademark litigation, he has also drafted discovery motions and motions in limine. With respect to copyrights, Thomas has helped to prepare trademark applications for website, database and software filings. He frequently performs legal research across all areas of IP.
